Elon Musk is suing his friend and former Twitter CEO Jack Dorsey as he seeks to back out of his $ 44 billion (£ 37 billion) deal to buy the social media company, according to a court document.

Chief Tesla – the richest man in the world – announced his plan buy Twitter in April, but it’s time struggling not to buy it.

Mr Musk and Twitter are headed for a court showdown on October 17 that is expected to determine whether Twitter can force the billionaire to go through with the purchase.

This month, the founder of SpaceX sold $ 6.9 billion (£ 5.7 billion) of its Tesla shares as his fight with Twitter continues.

Musk said Twitter did not provide adequate information on the number of fake or “spam bot” Twitter accounts and that it violated its obligations under the agreement by firing top managers and firing a significant number of employees.

Mr. Musk’s team expects more information about the bot numbers to be revealed in the court’s discovery process when both parties are required to turn in evidence.

Twitter argues that Mr Musk’s reasons for retiring are just a cover for buyer’s remorse.

The subpoena against Mr. Dorsey was served last week and asks him for documents and communications relating to the acquisition, as well as information on the effect of fake or spam accounts on Twitter activity and its measurement of daily active users.
