Why Prosecutor Says She’s Pursuing Criminal Charges That ‘Rust’ Shot Was Accidental

Prosecutors plan to charge actor Alec Baldwin with manslaughter in the filming of the murderous 2021 film ‘Rust’.

“‘Rust’ actor and producer Alec Baldwin and gunsmith Hannah Gutierrez-Reed will each be charged with two counts of manslaughter in the death of Halyna Hutchins in the Santa Fe County film set in 2021,” said Mary Carmack, New Mexico’s first judicial district attorney. – Altwies announced in a statement Thursday morning.

Baldwin and Gutierrez Reed will be “alternatively charged” with two counts of manslaughter, meaning a jury will decide not only whether the two are guilty, but also under what legal definition of manslaughter.

Either way, a conviction carries a sentence of up to 18 months in jail and a fine of up to $5,000, according to the district attorney.

But a definition would imply an improvement in firearms, or an additional mandatory sentence, because a firearm was involved. In this case, the crime could carry a mandatory sentence of five years in prison.

The district attorney said no charges would be filed for the non-fatal shooting of the film’s director, Joel Souza.

“After a thorough review of the evidence and the laws of the State of New Mexico, I have determined that there is sufficient evidence to bring criminal charges against Alec Baldwin and other members of the film crew. of ‘Rust,'” Carmack-Altwies said in the statement. “Under my watch, no one is above the law, and everyone deserves justice.”
