SC Upholds HC Ruling, Approves ‘Miracle Child’ Adoption by Malta-Based Couple | News from India

BAREILLY: The Supreme Court upheld the Delhi High Court’s decision to entrust the ‘miracle baby’ (the court only named her ‘S’) to her new parents based in Malta, who had adopted her through Central Adoption Resource Authority (CARA).
The ruling, delivered on Friday, which finally paved the way for Baby ‘S’ to be with his parents after months of legal proceedings, said: ‘They (the adoptive parents) were aware that Baby ‘S’ had a condition medical (epilepsy) and were still willing to adopt it.We find no reason to interfere with the judgment under appeal (HC).
In 2019, the little girl was found abandoned in a clay pot and got the nickname “miracle child” as she survived despite all odds.
Later, in December 2022, right-wing activists filed a FIR against the Bareilly orphanage and the adoptive parents, accusing them of “wrongful conversion” claiming that the orphanage had changed the child’s faith and obtained an Aadhaar with a “new first name”. As reported by TOI, the HC has ordered the UP government “not to harass orphanage staff and create obstacles in the child’s adoption process or her journey to Malta with her adoptive parents”.
The nephew of the ex MLA Pappu Bhartaul alias Rajesh Mishra, Amit, then approached the SC requesting “the annulment of her adoption” citing “discrepancies in the process”.
Primrose Edmundsuperintendent of the Bareilly orphanage Warne Baby Foldshe told TOI: ‘We will be contacting the district administration to complete the adoption formalities as her birth certificate, passport etc have not yet been completed.’
