High jumper Tejaswin Shankar to be part of Indian contingent for CWG 2022: HC told | Commonwealth Games 2022 News


NEW DELHI: The Athletics Federation of India (AFI) told the Delhi High Court on Wednesday that it will include the name of Tejaswin Shankara high jumper, in the list of players who are part of the Indian contingent for the upcoming Commonwealth Games in Birmingham in 2022.
Judge Yashwant Varma, hearing a motion by the sportsman against his exclusion from the squad of players selected for the sporting event, ordered the AFI to immediately transmit his name to the Indian Olympic Association (IOA) for action and said the court expected both AFI and IAO move forward while keeping in mind the prescribed deadlines.
The AFI lawyer informed the court that there was a vacancy as one of the athletes, who was part of the Indian contingent for the relay event, was disqualified and therefore the name of the claimant must now be transmitted instead.
The Commonwealth Games (CWG) are due to be held in Birmingham from July 28 to August 8.
“Mr (Hrishikesh) Baruah, a learned barrister appearing for AFI, on instructions, informed the court that Arokia Rajiv, an athlete who was part of the four by four hundred relay team, was disqualified in trials that took place,” the court recorded in the order.
“He therefore submits that in view of the resulting vacancy, the petitioner’s name should be included and forwarded immediately among the list of athletes forming part of the Indian contingent for the next CWG,” he added.
“The statement so made is recorded and accepted. That the AFI accordingly and immediately forward all details to the IOA who may take further consequential action,” he said.
The court further said it would hold the motion in abeyance to consider the issues raised so that “this national embarrassment does not happen again.”
“Having heard at some length yesterday from the learned counsel for the parties and having regard to the documents which had been made available to it, the tribunal concludes that the issues raised in the motion in brief, including the question of the selections made in accordance with the standards prescribed by the ‘AFI or the CWG, the right of athletes training or competing overseas at the time of in-country testing, the waiver process would merit further consideration so that disputes such as this to which the athlete petitioner was faced with not happening again,” the court said and scheduled the case for a rehearing on August 25.
The court ordered that the relevant statistics and standards relied on by the petitioner be entered into the record by way of an affidavit and also granted the AFI as well as the IOA the opportunity to file any affidavit they deemed necessary.
The court will define the issues worth considering after hearing from the parties at the next opportunity, he said.
Senior Advocate Gopal Sankaranarayanan, representing the petitioner, said that since the team is leaving for the event on Thursday, all necessary formalities regarding the petitioner’s inclusion should be completed within the day.
The petitioner had appealed to the High Court last month against his exclusion.
Lead Advocates Mukul Rohatgi and Sankaranarayanan previously argued that the petitioner was wrongly excluded despite being the national record holder for the high jump (2.29m) and the only Indian to have reached the AFI qualifying standard and won a gold medal at the National Collegiate Athletic Association. (NCAA) 2022 Outdoor Track and Field Championship in Eugene, Oregon in the United States.
It was also alleged that the petitioner requested an exemption from the Interstate Championships as they clashed with the NCAA Championship and informed the Head National Coach through a message on WhatsApp.
