TOI asked him whether the judiciary has unwittingly given precedence to the cases of the rich and influential, who hire renowned senior lawyers assisted by a battery of lawyers, over the cases of the poor and marginalized who could not afford even a lawyer.
Judge Lalit said: “The cases of the rich and famous attract the attention of the media and the public. These cases and the judgments of the courts are discussed and debated. But any of the media never paid attention to Ram’s cases Lal or Shyam Lal? Every day we decide many cases presented by ordinary citizens. But nobody notices it ».
“We as judges can devote a little more time to a senior lawyer because he brings court experience, knowledge and skills. This doesn’t mean we don’t listen to young or inexperienced supporters. The primary function of the Supreme Court is to dictate the law. In that process, we hear from anyone who is assisting in a meaningful way, ”she said, adding personally that she never differentiated between a young man or an experienced attorney when arguing before him in a case.
He said that decisions made by constitutional courts must have three Cs: clarity, consistency and certainty. “These features are a must in decision making at the highest level. Once this is achieved, the decisions and logic employed will soon pass to the HCs and will help them apply the same principles when deciding similar cases, “she said.
He is also of the opinion that, instead of having law graduates as law clerks, young bailiffs could be appointed as law clerks in constitutional court judges.
