NEW DELHI: The Supreme Court on Tuesday declined to consider a plea to detain the lawyer Lekshmana Chandra Victoria Gowri from taking the oath as a judge of the Madras High Court.
“We are not considering the written petition. Reasons will follow,” said a special bench consisting of judges Sanjiv Khanna and BR Gavai.
Meanwhile, Gowri was sworn in as an additional judge of the Madras High Court.
Appeal to the Supreme Court
On Monday, a panel chaired by Chief Justice DY Chandrachud had filed the request of three Madras HC lawyers opposing Gowri’s appointment for the February 10 hearing, but later advanced it to February 7 after the l Senior lawyer Raju Ramachandran spoke again, saying that the Center has served notice of his appointment.
Controversy against Victoria Gowri
The petitioner’s lawyers, Anna Mathew, Sudha Ramalingam and D Nagasaila, had referred to Gowri’s alleged hate speech against Muslims and Christians in their appeal.
The plea read: “The petitioners are seeking appropriate interim orders injuncting the 4th defendant (Gowri) from being sworn in as a High Court judge, in view of the ‘grave threat’ to judicial independence.”
What the petitioners wanted
The petitioners had opposed the recommendation of the Supreme Court panel to appoint lawyer Lekshmana Chandra Victoria Gowri for judgment in the Madras High Court and requested his recall.
In separate letters addressed to President Droupadi Murmu and the Supreme Court panel, the group of lawyers opposed the panel’s recommendation, saying its appointment would undermine the independence of the judiciary. Gowri, by her own admission, is the general secretary of the Bharatiya Janata Party Mahila Morchreads the memorandum signed by 22 lawyers including senior lawyers NGR Prasad, R Vaigai, Anna Mathew, D Nagasaila and Sudha Ramalingam.
